Terms and Conditions
NexFlight
Effective Date: October 4, 2026
Last Updated: October 4, 2026
These Terms and Conditions govern your use of https://www.nexflightdrones.com and establish general terms for services provided by NexFlight (“we,” “us,” or “our”), based in Phoenix, Arizona.
Please read these terms before using our website or booking services. Project-specific terms will be provided in a written proposal, quote, or service agreement.
1. Website Use and Service Agreements
You may use our website for lawful purposes, including learning about our services, viewing our work, downloading available resources, and submitting inquiries.
Submitting a contact form, requesting a quote, or downloading a resource does not create a confirmed booking or service agreement.
A booking is confirmed when both parties accept the project terms in writing and any agreed booking requirements are satisfied. If a signed service agreement conflicts with these general terms, the signed agreement controls for that project.
2. Services
NexFlight provides aerial photography, videography, and related services as described in the applicable project agreement.
The scope of each project may include:
-
Project locations and scheduled visits.
-
Photography, video capture, and editing.
-
Deliverable quantities, formats, and resolution.
-
Delivery timelines.
-
Included revisions.
-
Content licensing and permitted uses.
Services or deliverables outside the agreed scope require additional written approval and may result in additional charges.
Unless expressly included in a written agreement, aerial imagery is not a certified survey, engineering assessment, structural inspection, or other professional technical opinion.
3. Quotes, Packages, and Pricing
Website pricing and package descriptions are subject to availability and the requirements of the project.
Final pricing may depend on location, travel, project complexity, scheduling, editing requirements, additional visits, and requested deliverables.
A quote is valid for the period stated in that quote. Additional fees, taxes, and expenses will be disclosed before the client approves them.
Changes to an accepted project scope must be agreed upon in writing, including any changes to price or delivery dates.
4. Payments and Deposits
Payment amounts, deposit requirements, and due dates will be specified in the accepted quote or service agreement.
If a deposit is required, the project date may remain unreserved until the deposit is received and the booking is confirmed.
Any conditions concerning deposit refunds, cancellation charges, late fees, or withholding final deliverables must be disclosed in the project agreement before booking.
We may pause work for overdue payments after providing notice, subject to the agreement and applicable law.
5. Scheduling and Delivery
Project dates are subject to availability, site access, flight feasibility, and any required authorizations.
Delivery timelines will be stated in the project agreement. Client delays in providing information, access, approvals, or feedback may affect those timelines.
We will communicate material scheduling or delivery changes as reasonably practicable.
6. Weather, Flight Safety, and Operating Restrictions
Aerial services depend on safe conditions and lawful flight operations.
Weather, airspace restrictions, temporary flight restrictions, obstacles, nearby activity, equipment issues, or other conditions may require a change to the capture plan or schedule.
The remote pilot has final authority over flight-safety decisions. NexFlight may decline, modify, postpone, or stop a flight when necessary for safety or compliance.
Property access or owner permission does not guarantee that a flight is authorized or feasible.
If a scheduled shoot cannot proceed, we will discuss rescheduling or alternative arrangements. Any charges, credits, or refunds will be handled under the accepted project agreement and applicable law.
7. Client Responsibilities
Clients are responsible for:
-
Providing accurate contact and project information.
-
Identifying the intended use of the photographs or video.
-
Arranging authorized access to the property and relevant work areas.
-
Coordinating with property owners, managers, and on-site personnel.
-
Preparing the location for the agreed shoot.
-
Disclosing known site hazards, sensitive areas, and filming restrictions.
-
Providing timely instructions, approvals, and feedback.
-
Obtaining permissions for client-supplied materials and any releases assigned to the client in the project agreement.
Clients must not request unlawful or unsafe operations.
NexFlight remains responsible for flight-related authorizations and operating decisions within its control.
8. Cancellations and Rescheduling
Please submit cancellation or rescheduling requests as soon as possible using the contact information below.
Notice periods, cancellation charges, deposit treatment, and rescheduling fees will be specified in the accepted project agreement.
These website terms do not establish an automatic nonrefundable deposit or cancellation fee.
If NexFlight cancels a project and the parties cannot agree on a replacement date or alternative service, amounts paid for services that will not be performed will be refunded, subject to any lawful, expressly agreed charges for work already completed or approved expenses.
9. Deliverables and Revisions
Final deliverables will be provided in the quantities and formats stated in the project agreement.
Requested shots are subject to safe access, actual site conditions, and lawful operations. Specific angles, lighting, or flight paths cannot be guaranteed unless expressly agreed and feasible.
Included revisions and the process for requesting them will be defined in the project agreement. Additional edits, new creative directions, reshoots, or deliverables may require a separate quote.
Raw footage, unedited photographs, and editing project files are included only when expressly stated in writing.
Clients should download and back up delivered files. Any guaranteed storage period or replacement-file service must be stated in the project agreement.
10. Copyright and Content Usage
Copyright ownership and the client’s rights to use project photographs and video will be specified in the written project agreement.
Unless otherwise agreed in writing, NexFlight retains copyright in its original work and grants the client a nonexclusive license, after full payment, to use the delivered final content for the project purposes identified in the accepted quote or agreement.
A copyright transfer, exclusive license, resale right, or right to sublicense content requires a separate written agreement.
Clients retain ownership of materials they supply and grant NexFlight permission to use those materials as needed to complete the project.
Third-party materials, including music, may carry separate licensing restrictions. Those restrictions must be observed when using the final content.
11. Portfolio and Promotional Use
Any permission for NexFlight to display client project content in its portfolio, website, social media, or promotional materials will be addressed in the project agreement or obtained separately.
Clients should identify confidentiality requirements and restrictions on publication before the shoot.
These website terms alone do not grant permission to publish confidential project information or identifiable individuals for promotional purposes.
12. Website Content and Free Resources
Website text, branding, graphics, photographs, videos, and downloadable resources are owned by NexFlight or used with permission, unless otherwise indicated.
You may access and use free resources for your own personal or internal business planning. You may not resell, republish, or distribute them as your own without written permission.
Free resources and blog content provide general information. They do not replace project-specific advice, legal guidance, or a professional technical assessment.
Nothing in these terms limits uses permitted by applicable law.
13. Prohibited Activities
You must not:
-
Use the website for unlawful or fraudulent purposes.
-
Submit materials you do not have permission to use.
-
Attempt to gain unauthorized access to website systems.
-
Introduce malicious software or interfere with website operation.
-
Impersonate another person or misrepresent your authority.
-
Use website content in ways that infringe intellectual property or privacy rights.
14. Third-Party Services and Links
Our website may link to third-party websites or use third-party services for features such as video playback, communication, or payment processing.
Those providers operate under their own terms and privacy policies. NexFlight does not control their websites or services.
15. Privacy
Our Privacy Policy explains how we collect, use, and disclose personal information associated with our website and inquiries.
Please review the Privacy Policy before submitting personal information.
16. Website Availability and Results
We make reasonable efforts to keep website information accurate and current, but occasional errors or interruptions may occur.
The website and free resources are provided on an “as available” basis, subject to applicable law.
NexFlight does not guarantee that photographs, videos, or other content will produce a particular level of sales, inquiries, property interest, or business revenue.
This section does not reduce obligations expressly accepted in a project agreement.
17. Liability and Applicable Rights
Each party remains responsible for its obligations under the applicable project agreement and law.
Any project-specific limitations of liability must be stated in the accepted service agreement and remain subject to applicable law.
Nothing in these terms excludes liability or waives rights that cannot legally be excluded or waived.
18. Governing Law and Disputes
These terms are governed by the laws of the State of Arizona, except where applicable law requires otherwise.
If a concern arises, please contact NexFlight so we can attempt to resolve it promptly and in good faith.
Unless otherwise agreed in a valid written agreement, unresolved disputes may be brought before a court with appropriate jurisdiction. These terms do not require mandatory arbitration or waive access to small claims court.
19. Changes to These Terms
We may update these terms by posting a revised version with a new “Last Updated” date.
Updates apply prospectively. Changes to an existing accepted project agreement require the agreement of both parties, unless that agreement lawfully provides otherwise.
